furlough inter alia on the
above-stated ground was rejected by the competent authority in view of para
26.1 of the Parole/Furlough Guidelines ... Hence, he is not eligible as
per para 26.1 of Parole/Furlough Guidelines, 2010
which states as under:-
26.1. "Good conduct in the prison

case as party-in-person and for that purpose, he is seeking parole from this Court. The State has filed a counter contesting the claim ... order, it is seen that leave in Delhi is governed by Parole/Furlough Guidelines, 2010, whereas, in the State of Tamil Nadu, rules relating
reasons:-
"(i) As per the extant guidelines, para 12.5 of
Parole/Furlough Guidelines 2010 which specifies that
"parole would ordinarily be not granted ... impugned herein are concerned, it is trite to observe
that the Parole/Furlough Guidelines, 2010 are merely guidelines and cannot
be applied blindly in every
following:-
(iii) The convict is not entitled for parole as per
para 11.5 of Parole/Furlough Guidelines
2010 which provides that "A minimum ... circumstance that six months, as
stated in Para 11.5 of the Parole/Furlough Guidelines, 2010, have in fact
elapsed since the time the petitioner last
convict is not entitled for parole in view
of Para 11.5 of Parole/Furlough Guidelines:
W.P.(CRL) 926/2016 Page ... availed 15 days
parole up to 03.09.15 by the order of DHC.
(ii) As per Para 11.2 of the Parole/Furlough
Guidelines, the convict
view of the following :-
(i) As per Para 11.2 of the parole/furlough
guidelines, the convict is not eligible for
release on parole which provides ... Jail Superintendent has not
recommended the parole of the convict.
(ii) As per Para 11.4 of Parole/Furlough
Guidelines which provides that "the convict
direction to the official respondent to release the petitioner on
parole in order to enable him to maintain social ties with family and society ... convict is not entitled for parole as per
para 11.5 of Parole/Furlough Guidelines
2010 which provides that "A minimum of
six months ought

(i) The convict is not entitled for parole as per
para 12.5 of Parole/Furlough Guidelines
2010 specifies that "parole would ordinarily ... parole w.e.f.
30.03.2015 to 30.04.2015, after considering the scope and ambit of para 12.5
of Parole/Furlough Guidelines, 2010. Insofar as, the other
convict is not entitled for parole in view
of Para 11.5 of parole/Furlough
Guidelines:2010 which provides that "a
minimum of six months ... police verification. Even otherwise, the applicability of Para 11.5 of the
Parole/Furlough Guidelines: 2010 is no longer relevant since the petitioner
was last released
