parole. There is every
possibility that the convict can harm the victim and
family members as well. The possibility of
jumping the parole ... cannot be ruled out. There is
every possibility of convict to commit similar
offence cannot be rules out. The grant of parole of
convict
reasons:-
"(i) The convict is not entitled for parole as per para 11.1
of Parole/Furlough Guidelines 2010 which provides that
"a convict ... report, the threat to the life of convict during the
parole cannot be ruled out.
Further, the convict if desires, can file SLP from jail
heinous crime.
The possibility of jumping the parole and committing
similar offence by the convict cannot be ruled out.
There is possibility of some dispute ... parole may result in breach of public peace and the possibility
of his jumping parole and committing similar offence cannot be ruled out,
without alluding
direction to the official respondent to release the petitioner on
parole in order to enable him to engage counsel; arrange funds for filing ... victim/witness. The
possibility of jumping the parole by convict can
not be ruled out.
(ii) In the absence of requisite police verification
report regarding
direction to the official respondent to release the petitioner on
parole in order to enable him to take care of his old aged mother ... order in the society. The
possibility of jumping the parole cannot be ruled
out.
Further, the convict has last availed one month
parole
direction of mandamus to the competent authority to release the petitioner on
parole in order to enable him to take care of his ailing mother ... family members
over the convict. The possibility of jumping the
parole cannot be ruled out.
Further, the convict is also involved in another case
convict is not entitled for parole in view of
Para 11.1 of Parole/Furlough Guidelines: 2010
which provides that "a convict must have
served ... party/witnesses. The
possibility of jumping the parole and getting
involved in another criminal case cannot be
ruled out.
Further, the convict, if desires
petitioner is aggrieved by the order dated 07.10.2015 whereby his
representation for parole on the above ground was rejected by the Competent
Authority for the following ... apprehension that the
possibility of jumping the parole and committing similar
offence cannot be ruled out.
Further, the convict has last availed 01 month parole
direction to the official respondent to release the petitioner on
parole on the medical ground of his aged father who is a patient of throat ... engaging in gang activity cannot be
ruled out.
As per record convict has last availed one
month parole up to 08.11.2014 by the order
date of termination of
the previous parole." The convict has previous
availed 01 month parole upto 03.10.2015 by the order
of DHC.
(iii) Adverse ... area after releasing of
convict on parole. The possibility of jumping the
parole cannot be ruled out. Convict is involved in 13
criminal cases
