Rule 4(2) of the Haryana
Good Conduct Prisoners Rules, 2007 (hereinafter referred to as Rules of
2007), he is not entitled to parole ... imposed by
Rule 4 of the Rules of 2007 had held that there being no such restriction in
the Act, the Rules cannot supersede
therefore, he is entitled for regular first parole as
per Rajasthan Release of Prisoners on Parole Rules, 1958 but his prayer for
release on parole ... refuse regular parole to the petitioner. Therefore, I deem it
proper to grant first parole to the petitioner for 20 days under Rule
submitted that
as per the Rajasthan Prisoners Release on Parole Rules,1958
permanent parole cannot be granted before completion of 14
years of sentence, therefore ... years of
sentence, therefore, not entitled for permanent parole.
We have perused the Parole Rules also in which there is no
restriction for granting permanent
provided for in terms of
Rule 4 (1) of the Haryana Good Conduct Prisoners (Temporary
Release) Rules, 2007 ('Rules' - for short).
