when the District Parole Committee, Bhilwara was
found dealing with the parole prayers under the Rajasthan Prisoners
Release on Parole Rules, 1958 ('the Rules ... after 5 years of imprisonment [vide Rule 9 with Rule
15]. Noteworthy further it is that while granting parole, it is the jail
conduct that

first regular parole in accordance with the Rules of 1958 but his

The respondents ... submissions that
Rule 10-A of the Rajasthan Prisoners Release on Parole Rules,
1958 does not envisage emergent parole on the ground
alia, it is submitted that under Rule 10A of the Rules, the
prisoner cannot be granted emergent parole on the ground of death ... deserves to be declined.
Rule 10A of the Rules reads as under:-
"10A.(i) Notwithstanding the provisions of rules
reasoning
of the parole committee for want of details on the ailment of
the convict. If the District Parole Committee was of the
opinion ... passed in accordance with law keeping in view
the requirement of Parole Rules."
It appears from the submission as made in the reply
petition seeking 20 days'
parole in accordance with the provisions of the Rajasthan
Prisoners Release on Parole Rules, 1958 (for short 'the Rules ... such, he is entitled for
first regular parole in accordance with the Rules of 1958. It is also
submitted that the petitioner belongs
benefit of parole by accepting his personal bond instead.
The petitioner submits that he has availed of the earlier two
paroles respectively for 20 days ... with reference to Rule 7 of the Rajasthan Prisoners
Release on Parole Rules, 1958. However, we are unable to find from the
reply submissions
