praying for a declaration that they are entitled for pathway
of five feet in width across Sy.No.231A/1B of Baad-I
Village ... holding that plaintiffs have got easementary right over the
suit pathway of five feet width in the aforesaid land. It is
also prayed
dispute that both the parties have
agreed that pathway is lying between the properties of
the plaintiff and the defendants and the same needs ... suit
property. They are merely interested in protecting 15
feet width of pathway. In view of such categorical
statement made by the defendants, confusion would
pathway in Sy.No.174 and that the
plaintiff has been drawing the water from the said
channel or has been using the pathway ... does not reveal the
pathway as well as water channel.
6. Even according to the plaintiff, the
pathway is having width of two to three
owners of Sy.No.31;
according to them, there is 8 feet width of cart way in
the land of the respondents and that ... what lies
adjoining the property bearing Sy.No.31 is only the
pathway and no cart way and therefore, appellants have
got every right
