and whereunder the concerned Executive Engineer was directed to
remove the generator ... regard, he
had made a written complaint before the then Vice Chairman, PRDA
on 09.07.2005. Pursuant to the said complaint, the then Vice
Chairman, PRDA

3. One Arun Kumar Sinha (PW 1) is the complainant,
who had made ... landlord was absent. An
application was made before the competent authority under PRDA
for requisite sanction for getting the said flat registered in the name
Bhagwat Kunj Apartment Plot No. 1440 and 1441
is duly approved by PRDA vide its order dated 16.06.2009 after
carrying out a detail investigation ... then Amin and Junior
Engineer of PRDA and the same was approved by the
Assistant/Executive Engineer, PRDA basing on the enquiry report
in which
aforesaid building because of a
fictitious / frivolous complaint in the PRDA regarding the
petitioners having made some deviations in the
construction plan and having encroached ... upon a public
land. The conclusion of the proceedings before the PRDA
took time and, therefore, the flats could not be finally
constructed and finished
sanctioned on
25.03.03 by the erstwhile PRDA and 12.11.08 by the
Patna Municipal Corporation, respectively, as
through the said revision the builder respondent has
sought
plan.
14. In Anup Kumar vs. PRDA & Ors [2008 (1) PLJR
183], in more or less similar circumstance while allowing the writ
petition, this

7. The Will was registered on same
stock register and the
said tender was not issued through PRDA and the articles received
from the firm was also not approved by BIS, thus
identical case, in CWJC
No.2686 of 2003 (Anup Kumar vs. PRDA & Ors), a Bench of
this Court held as under :-
