Dhoraji hospital, she gave history that while she was cooking, the 'primus' got burst, and therefore, she sustained burn injuries. Taking into consideration ... replied as under:
I am burnt while I was pouring kerosene in primus and my sari got wet with kerosene. Thereafter, when I was boiling
different items which were lying at the
place of occurrence wherein primus was lying without kerosene,
steel kathrot, two fried roti, one damicha (godra ... Next is PW-3 Amubhai Bhavsangbhai, Exh. 35 in whose
presence, primus was seized. He has also identified the sari, bra
and the pieces
incident, the deceased stated as under:-
I was making tea on
brass primus and as I tried to pump air in the primus ... excess
kerosene came out from the primus, there was sudden blast of
flames. As the flame of fire touched my face, I stood
daughter (the deceased) had
sustained burn injuries while blowing out the primus after preparing tea and
was shifted to civil hospital and hence, the complainant ... husband of the deceased,
he had stated that after preparing tea on primus, while blowing out the same,
due to sudden flaring up, the deceased
patient was conscious and she has stated that due to flame
from Primus Stove she has sustained burn injuries and the
Doctor examined the injuries ... able to hear. He has also seen
the Primus Stove at the scene of offence. He has stated that
he cannot say whether utensils were

she had sustained burn injuries on account of primus burst meaning
thereby, it was accidental. He then took to the second ... incident, nobody was present at the home and on account of
primus burst, she has burnt." Thus, if this statement is considered,
which
patient
has stated that she sustained burn injuries accidentally, from the
primus-stove.
The
next witness whose testimony would be of some importance ... deceased has
stated that she had sustained burns accidentally, from the
primus-stove.
On
the basis of the above evidence, the Trial Court has come
wherein she pleaded accidental
burns caused by fall of kerosene primus on the burning mosquito
repellent. The deceased succumbed to the burn injuries, sustained ... deceased about
the incident in question, she told her that the primus was pushed
down from above by a rodent. It appears that her statement
first dying declaration, she had stated that while
cooking food, on Primus stove, she pumped air which
inflamed the same, her clothes accordingly caught fire
