therein but also that the Secretary of the Grama

Panchayath should give evidence before the Court in
respect of the aforesaid document ... Trial
Court. The Trial Court merely considered the
necessity to procure the documents or otherwise.
Under these circumstances, the plea to summon the
Secretary
tender document. The tender
document is defined under Section 2(l) of the Transparency
Act. It reads thus:
"2(l) Tender document means ... Provided that for the purpose of e-
procurement, the 'tender papers' means
set of documents in electronic form"
11. From the said
application should have been
rejected. I.A. filed for production of additional documents
being consequential to the order of amendment it is
contended that this ... consequently filed the applications under the Right to
Information Act and procured these documents. Hence, at
the earliest point of time this application is filed
they have requested the
Registrar (Vigilance), High Court of Karnataka to
procure the documents in P & S.C.No.15023/2001 ... allowed. That
every effort shall be made to procure the records in P
& S.C.No.15023/2001 disposed
custody of the
documents, the applications cannot be allowed; that the
defendant is not the sole custodian of the documents,
especially in view ... petitioner to
file such applications as is necessary in order to procure
the documents or otherwise from the concerned
authorities. Petition stands disposed off with
transferee company was immobile and the applicant had
difficulty in procuring the documents.
Considering the circumstances narrated in its
totality, I am satisfied the applicant
have failed to prove by producing-'-.._any
documents. The non procurement of
documents, does not mean that the deceased Vlzasy
legal liability
and the documents were sought to be misused by the
complainant since she had procured them from the possession of
one Rajanna ... transaction, and therefore, the complainant
could not, on the basis of those documents, seek to enforce the
liability or allege that the offence had been
their names, therefore, they are beneficiaries of the
alleged forged documents and in spite of the same, they
have not been prosecuted for their acts ... copies and get stamped
endorsement on to it by procuring them from different

xerox copies
