5. The matter requires consideration
Bitumen was
always available on site, the HMPs capacity was only 240 tonnes and for
the remaining work, the Bitumen could not be procured owing ... source
approval or JMF approval of the material to be procured, the Bitumen
could in no way be brought to the site

the work. The department had authorized the claimant to
procure the bitumen from Indian Oil Corporation vide letter
No.7495-98. No objection
defrauding the government by submission of false
and bogus invoices showing procurement of bitumen. After investigation
chargesheet has been submitted against the contracting company
symbolic date of
4.10.2015 and not from actual date of procureement of the
Bitumen i.e. 26.03.2016. Same has also resulted in deducton of
excessive ... done after 26.03.2016. Similarly core
material i.e. Bitumen VG 10 and VG 30 was procured only after
26.03.2016.
