this is what Ray C. J. observed on this question in the same case:
"On partition, the Karta's power of management ... power to alienate the interest which she got under Section 3(2) of the Act. In the course of the discussion, Ray C. J. observed
adopted son as his guardian. I am unable to hold that the power of management was given independently of the exercise of authority to adopt ... inheritance of the personal property. Therefore, in ray opinion, the power to manage the estate was regarded by the testator as subsidiary and incidental
government the absolute power to act on its subjective satisfaction. The Court may not normally interfere with such exercise of power when the exercise ... said judgment Chief Justice A.N.Ray, speaking for the Court held -
"Administrative decisions in exercise of powers even if conferred in subjective terms
contention on behalf of the petitioners that in exercise of the power to amend the Constitution under article 368 of the Constitution of India ... very same decision, Ray, C.J., expressed the view that the constituent power is sui generis and different from legislative power.
