It has been submitted that a prayer for re-poll
was made via e-mail ... writ petition,
there is nothing to suggest that the application seeking
re-poll was submitted prior to the declaration of the
result.
The same
alleges massive
rigging, vandalism and violence at the time of poll.
It appears that complaints were lodged before
the authority on 13th and 14th July ... Applications filed by the petitioner at such a delayed
dates seeking re-poll, cannot be allowed.
In view of the above, no relief
crystal clear that the polling which took place was
not in accordance with the rules and regulations.
In fact, poll could not take place ... countermanding the poll. The same is required to be
reviewed by the Commission for taking a call with
regard to re-poll to be conducted
pertaining to
the polling station and only 14 ballot papers were
rejected during counting. Had there been any
irregularity during the poll it could have ... when the Presiding
Officer had opportunity to inform the same, the re-poll
could have been considered. It has also been
recorded that, the Panchayat
ballot papers by
issuing a proper seizure list.
The petitioner prays for re-polling and recounting
