sixteen Members who had tendered their
resignations to the Speaker (but whose resignations have not been accepted). On their
behalf, Mr Maninder Singh submitted that ... satisfied that such

resignation is not voluntary or genuine, he shall not accept
such resignation.‖
Sub-clause (b) of clause (3) of Article

some cases accepting request of petitioners for
resignation.
3. It is submitted by the counsel appearing for petitioners that
termination/acceptance of resignation of services ... said advisory/circular not to lay off its employees
and not to terminate their services. Termination/acceptance of resignation of
services of petitioners are contrary
before the resignation is accepted the person, who had tendered
to resign, recalls the said resignation, the appointing authority should not
act on such prayer ... withdraw the
resignation. Unfortunately, the department neither accepted the resignation
in time, nor allowed the petitioner to withdraw the resignation pursuant to
his letter written
unless suspended or cancelled by competent authority.
Thus, the resignation of dealership shall not be accepted

shall not be accepted within the minimum period of five years of
dealership.
