Constitution:
"94. A member holding office as Speaker or Deputy Speaker of the House of the People -
(a) shall vacate his office ... such member is the Speaker, to the Deputy Speaker, and if such member is the Deputy Speaker to the Speaker, resign his office
constituency units seem to be unconcerned."
Shri R. K. Khadilkar, Deputy Speaker, not only corroborates this but says that he actually knew of instances ... hearing and is reproduced below:--
DEFECTIONS
MPs and MLAs/MLCs who either resigned from one party and joined another,
or resigned only
Article 191 or (b) resigns his seat by writing under his hand addressed to the Speaker ... Chairman, as the case may be, and his resignation is accepted by the Speaker or the Chairman, as the case may be, his seat shall
resignation from the
membership of the party. In the said decision it
was further observed that even in the absence of a
formal resignation from ... that the Hon'ble Speaker was
justified in holding that the Appellants herein had
voluntarily resigned from their membership of the
Bharatiya Janata Party
writing in this connection to the Speaker of the Assembly to say that my resignation may be taken as being operative from
Deputy Speaker who was occupying the Chair did not permit him to use the mike, there is nothing unnatural about it. The Speaker failed ... Parliament. If such a resolution is carried a Speaker would have no alternative but to resign . . . . . In fact, in these days, he would probably feel
made. He has resigned from
the membership of the State Assembly on 6.7.2011 and the same has
been accepted by the Speaker of Punjab Vidhan
Speaker, the Speaker made these appointments.
Having made the appointments, on the next day he
tendered resignation and the Assembly was
suspended with imposition ... process. Thus, it was
not the Speaker which was pushing the matter on the
eve of his resignation. The selection from the panel
was also
inducement.
Dr. Sen used to visit Saint Stephen Hospital even after resignation
and that fact would have been proved by her only after his cross ... speaker mode so that all the present persons may listen to
the conversation. Dr. Sen intimated Sh. Kamal Handa on phone that
after resignation from
allowances’ of the Chairman and Deputy Chairman and the
Speaker and the Deputy Speaker of Parliament and State
Legislatures. The Vice President's Pension ... Speaker and Deputy Speaker and the Chairman and Deputy
