58. It cannot be forgotten that the creation of land parcels
would give impetus to the industrial development
ultimately conclude. Howsoever serious a crime may be, an accused has
a right to speedy trial as enshrined under the Constitution of India.
9 Over ... period of time, the trial courts and the High Courts have forgotten a
very well settled principle of law that bail
jurisdiction is invoked, unexplained delay coupled with the
creation of third-party rights in the meantime is an
important factor which also weighs with ... jurisdiction. As a constitutional
court it has a duty to protect the rights of the citizens but
simultaneously it is to keep itself alive
