page 115 of the said book:-
"General Sampling :
The careful and accurate sampling of milk is of
utmost importance in all analysis of milk ... cannot be said that the sample
taken was the representative sample and it is possible that the sample of
milk might not have a true
that before
collecting the sample of milk from the accused, the milk was not made
homogeneous and the sample which was taken from the same ... duty bound to ensure that the
sample which he took was representative and homogeneous sample of the
entire milk. In my considered view
report, milk fat was 4.7% and milk solids not fat were
7.02%, whereas according to the CFL report, milk fat was 3.4% and milk
solids ... sample of milk or milk products, the moment one month lapses from
the date of lifting the sample, and if any such case come
sample of milk or milk products, the moment one month lapses from
the date of lifting the sample, and if any such case comes ... change of sample. At the time of
lifting the sample, even the vendor is required to sign all the sample
bottles. Thus, even
samples with detergent and two samples with neutralizers respectively.
Detergent was also found in 103 samples (8.4%). Perhaps the reason may be
dilution of milk ... milk probably to enhance SNF. The presence of Skim Milk Powder
indicates the reconstitution of milk powder.
6. The non-conforming samples in the descending
were packet samples and 317 (83.2%) were
loose samples and in urban areas the total non confirming samples
were 845 (68.9%) out of which ... milk
probably to enhance SNF. The presence of Skim Milk Powder
indicates the reconstitution of milk powder.
6. The non-conforming samples in the descending
buffalo or goat or sheep milk or milk solids or a
combination therof by rapid drying. The milk fat content shall not
be less than ... produce sample in 5 days (from date of service of
summons which would again take some time). If sample is so produced,
the sample would
packed in three bottles and sealed. Form No.7 and one
sample of milk was sent for its chemical examination,
and the other two samples ... that there was irregularity with
regard to process of taking the milk sample.
11. Learned counsel for the appellant/State could not
point
quality and
unfit for human consumption. Intending to draw one sample from the milk
ice-candies, the complainant called one local witness named Birbahadur
Singh ... received report in due
course wherefrom it was seen that the sample of milk ice-candies (Jolly
Chap) did not contain declaration regarding addition, extraneous
only eleven
samples of fruits, four samples of vegetables, eleven samples of
non-vegetarian food items and ninety one samples of milk were
lifted ... Food Safety and
Standards Act, 2006 are directed to ensure random
sampling of milk and vegetables and carryout
prosecutions where such products tests positive
