3. The prosecution filed CDs containing voice samples and voice
recordings of the respondents in support of the case. The cognizance ... inadvertently. However, the CDs in respect of the above voice samples
and voice recordings were already filed and placed on record. Learned
Counsel
investigation, voice sample of the applicant was sent to the
FSL and the opinion expressed is as under:-
"xxx
(ii) No sufficient voice exemplars ... case.
8. On a perusal of the material placed on record, the voice sample
insofar as applicant is concerned, the FSL report is inconclusive
complainant, who was the maker of the recording,
failed to identify his voice as well as the voice of the appellant in his
testimony. That ... identity of the recordings. TLO conceded in his testimony that he did not
record the specimen of the voice sample of the complainant
further stated that during the course of investigation voice
samples of the petitioner were recorded at FSL and upon analysis, the same
matched with ... voice sample from intercepted calls. The petitioner is also
found involved in another case being FIR No.304/17 registered under
Section 18 NDPS
Learned APP, however informs no voice samples have been
taken to establish the identity of the voice in the recordings. He further states
that ... Crores. Moreover, with respect to the alleged
voice recordings admitting liability concededly, no voice samples have been
taken to establish that it was the respondent
evidence does not exist, as all
documents/electronic records relevant to the case, including voice samples, have
already been seized. It was also urged that ... come on record that the mobile phone and laptop of the applicant
have been seized and he has also given his voice samples.
13. Reportedly
that the
applicant has already given his consent for recording of his voic e sample
and undertakes to appear before the FSL from
Report. During investigation
the recorded voice as well as the applicant's voice sample were sent to FSL.
As per the report received from ... father of the child victim had
also recorded the ransom call which alongwith the voice sample of the
present applicant, was sent for voice matching
with respect to the CDs that
contained the voice recordings and the voice samples of the
respondent/accused. It was the case of the petitioner ... marked S-1 & S-2 contained
the voice samples of the respondent/accused.
3. Learned counsel for the respondents submitted that in the aforesaid
stated that for taking the voice specimen
sample, the appellant was given an extract from the questioned
