54. As aforesaid the second dying declaration goes
beyond the first dying declaration and if the second
dying declaration is considered, then
police have recorded her statement which is her first dying
declaration. In the said dying declaration, at the earliest
point of time, the deceased ... With respect to second dying declaration,
though the accused has not specifically denied the dying
declaration recorded by the Tahasildar, however, they
suggested
second dying
declaration recorded by the Taluk Executive Magistrate
as per Ex.P.5 ignoring the first dying declaration -
Ex.P.16 made ... dying declarations i.e., one in the complaint made
by the Tahsildar and the first dying declaration -
