8. A bare perusal of the Section 124A would makes us wonder and
to our wildest of imagination
light of the above clause (d) of proviso to section 124A of the
Railways Act. Supported his report submitted to the Sagar Police and registered ... therefore, clearly a "passenger" for the purpose of section 124A as
clarified by the Explanation. It is now to be seen, that under
award made in favour of the
respondent in violation of the Section 124A(b) of the Railway Act, 1989.
3. The deceased is the mother ... incident as
specified in Section 123(c)(2) of the Act. To attract any of the exceptions
under Section 124A proviso, may have
accidental falling of any passenger from a train
carrying passengers.
7. Section 124A of the Act provides as follows:
“Compensation on account of untoward incidents ... fall within the exceptions (a) to (e) of proviso to Section 124A of
the Act and the 'accidental fall' would include a passenger
accidental falling of any passenger from a train carrying
passengers.

appellants have not been able to discharge
Section 128 of the Railways Act, 1989, which clearly stipulate that the right of any person to claim compensation under Section 124 or Section 124A ... right of any person to claim compensation under Section 124 [or Section 124A ] shall not affect the right of any such person to recover compensation
