petitioner/complainant was not recorded, as
required under summary procedure, contemplated under Criminal Procedure Code . A show cause notice was issued to the
appellants/opposite ... their presence, for their examination, by taking
coercive measures contemplated under Sec.205 of Cr.P.C.
Therefore, there can be no
doubt that
Section 2(1)(c) but it is a complaint as used in Section 200 of the Code of
Criminal Procedure. Summary trial procedure
is applicable ... hearing before the Forum applying the principles of Section 205 of the Code of
the Criminal Procedure.
Considering
the aforesaid it appears that when
under
Section 195 of the Code of Criminal Procedure, cognizance of such offences
punishable under Sections 193 to 196 (both inclusive), 199,200, 205 ... both inclusive) and 228 of the Indian Penal Code can be taken by a Court, as
per proviso to this Section, only on the complaint
Forum, without
following proper procedures laid down under Section 27 of the
Consumer Protection Act, 1986 and Section 262 of Cr.PC imposed jail
sentence ... parties and
have also perused the record of the Execution Case No.205/2016 of the
District Forum.
