39. This takes us to the next question as to
whether under Section 209 , the Magistrate was

assumption of such jurisdiction. The provisions of
Section 209 will, therefore, have to be understood
as the learned Magistrate playing
Section 195 (b)(i) of
the CrPC that no Court can take cognizance of any offence under
Section 193 and Section 209 ... Court on a private complaint in
relation to offence under Section 193 and Section 209 of the
IPC.
26. I, therefore, find no merit
automatically terminated. However, the learned
counsel for the petitioners referred Section 209 of
Indian Contract Act, which reads as follows:-
209. Agents duty on termination ... death of the principal

and preserve the interest of the principal

14. The above section does not make an inroad
into Section 209 because the former is intended to cover
