as under:
"9. The scheme envisaged in the Code of
Criminal Procedure indicates that ... conducted

this laxity is impermissible in the Sessions
by virtue of Section 225 CrPC, which pointedly states that the

17. We have already explained the distinction
between
Sessions by invoking the
provisions of section 323 Cr.P.C., which reads thus:-
"323. Procedure when, after Commencement
of inquiry or trial, Magistrate ... case under Chapter XVIII
Cr.P.C ., which commences from section 225 Cr.P.C. The
learned Sessions Judge on examination of investigation
records should
order dated 25.1.2016 passed on I.A.3 filed under
Section 225 of Cr.P.C. in S.C.280/2012 on the file ... court
of Sessions.
8. In this view of the matter, Section 225 of
Cr.P.C. has to be mandatorily followed and therefore, the
learned

3000 had extensively considered the status and
responsibilities of Public Prosecutor, method ... Government for appointment of a Special Public
Prosecutor afresh.
12. Section 225 of Cr.P.C would clearly disclose
that every trial before the court
incriminating evidence
was found against respondent/accused No.14. Statement
under section 313 of Cr.P.C. was dispensed with. By the
impugned judgment, respondent ... ground that the procedure
