therefore the case would certainly fall under Clauses Thirdly and
Fourthly to Section 300 IPC and therefore the trial Court rightly convicted

6. In light of the above factual scenario, few decisions
after medical intervention, then fourthly clause of
Section 300 of IPC would be applicable. Section 300 (Fourthly) of
IPC reads as under :-
