Prior to substitution by Section 8 of the Criminal Law
(Amendment) Act, 2013 (w.e.f. 3.2.2013), Section 370 stood as
under :
"Section 370 ... Sections
3 , 4 and 5 of the Immoral Traffic (Prevention) Act, 1956, is
concerned. So far as the offence under Section 370 of the
Indian
involvement of more
than one victim, then sub-section (3) of Section 370 of IPC is
attracted. No where it is stated that the petitioners ... provisions, I find no other
interpretation to sub-section (2) to Section 370 A of I.P.C. to refer the
matter to any larger
involvement of more than one victim, then sub-
section (3) of Section 370 of IPC is attracted. No where it is
stated that the petitioners ... Section 370A(2) of I.P.C.
Even on reanalysis of the provisions, I find no other
interpretation to sub-section (2) to Section 370
accused Nos. 1 and 2 committed offences
punishable under Section 370 , 370(A)(2) of Indian Penal
Code and petitioner/accused No.3 has committed ... Section 3 , 4 and 5 of Immoral Traffic (Prevention) Act, 1956,
the prosecution is maintainable under Section 370-A

made liable for the offences under Sections 3 and 4 of the
Act.
However, so far as Section 370(A)(2) IPC is concerned,
even ... offence under Sections 3 and 4 of
the Act is concerned and dismissed so far as the offence under
Section 370(A)(2) IPC.
