without the same being subjected to
the operation of lis pendens under Section 52 of the Transfer of
Property Act, 1882 subject to whatever terms ... section 52 of T.P. Act. Section
52 surely applies in our case. But section 52 itself provides
for the Court granting relief from lis
were hit by the doctrine of lis pendens as per Section 52 of the Transfer
of Property Act, 18824; and that the defendant ... sale transaction is clearly hit by the doctrine of lis
pendens as per Section 52 of the T.P. Act; and, for want of bona
impleadment,
therefore, the Court has held that the principle of lis pendens
Section 52 of the Transfer of Property Act will be applicable ... deeds were executed in

to play in the matter and as such
