inter alia observed as follows:-
"It was a case of self strangulation in a lying down position.
The photographs coupled with the expert opinion ... ligature strangulation;
(vii) That the death cannot be caused by self strangulation as the
person shall lose consciousness after applying initial force;
(viii) That there
wielded a knife to
the appellant accused and for his self-defence, appellant had strangulated the
neck of the deceased with the help
neck of deceased Chhayabai may
be caused by self hanging. The hanging as compared to
strangulation is mostly suicidal. Further, the ligature marks usually
appear
self-
control cannot be ruled out. And in the said transaction the
accused had cut the nylon rope tied to the grill and strangulated
Talwalkar
manual strangulation and hyoid bone was found fractured. Learned Senior Advocate submits that case put up by prosecution is self contradictory as applicant
Gurugram, wherein, he stated that he along with co-accused Vikram had
strangulated the deceased Vicky under the influence of liquor. Further ... self
contradictory, inasmuch as, on the one hand accused Manoj @ Choti confessed
before the police that he along with Vikram had strangulated the deceased
under
same was deficient behind
the left ear as the mark for strangulation to have been made by
some other person would have been all around ... presumption that it may not be strangulation by some other
person and rather may be a case of self-hanging. Moreover, in
the tentative view
establishes that death was due to
strangulation, but at the same time indicates that it was a self-act
of suicide ... found on the
neck, which clearly shows that death was due to strangulation,
which cannot be said to be death due to natural causes
death was due to "asphyxia as a result of ligature
strangulation".
23. The defense tried to elicit that the death of deceased ... strangulation the genitalia will
be swollen. P.W.13 has further denied the suggestion that the
injuries found on the dead body are self inflicted
