more than three months; (ii) tenure, including commission, appointment, enrolment, probation, confirmation, seniority, training, promotion, reversion, premature retirement, superannuation, termination of service and penal deductions
earlier to Direct Appointee Respondents, they were not
confirmed though the latter were confirmed and as seniority in the
cadre of Deputy Superintendent of Police ... linked up with seniority rule because, not the date
of entry in service determines the seniority but the date
of confirmation determines seniority and, therefore
confirmation.
(ii) All confirmations under the rule
shall be notified in the United
Provinces Gazette.
Rule 23 Seniority in the service shall be
determined according ... probation as well as they
being not confirmed and their confirmation being not
notified in the United Provinces Gazette before 1956,

date of confirmation determines seniority. Quota rule being
inextricably intertwined with the seniority rule any
delinking would render the seniority rule wholly

February 2006, Rule 5 of the Seniority Rules provided as follows:
"5. Joint inter se seniority of confirmed employees in
