33. Additionally, on 21.05.2023 petitioner further deposed that
Sarvothaman Guhan provided information that he
acquired prohibited substances using a courier service, which
were then dispatched to the residence of Rahul Mishra
wherein the respondent Nos. 2, 3 and 4 have refused the courier service,
respondent No. 1 has been served through his official e-mail namely ... respondent No. 2, 3 and 4 have refused the courier and speed
post service, it is deemed that they have been served. There
service, the respondents have been served
through speed post and courier. Despite service, there is nobody
appearing on behalf of the respondents
Delhi address as well as
Ranchi address.
5. The copy of the courier receipt shows that the Award was served upon
the petitioner ... shows that the petitioner
"refused to accept" the service of the courier on 20.04.2018.
7. In this regard, the law is settled that
Rules, 2002
which reads as under:
"3. Demand Notice:-(1) The service of demand notice as
referred to in Sub-section (2) of Section ... borrower or his agent empowered to
accept the service or by Speed Post or by courier or by any
other means of transmission of documents
