husband and they were asking her to take her share from
parent's property. Her daughter also informed that the aforesaid
persons were also ... harassed and beaten by the accused
persons for share in parent's property. On 25.12.2015, she
alongwith her daughter Anita were alone at their
estate left by the
parents of the parties and comprehensive list of assets of the
parents has been mentioned in the plaint. It is stated ... intestate, all the parties are entitled to one-
fourth share in the estate of their parents.
ARGUMENTS OF DEFENDANT NO. 1:-
30. On this insistence
their written statement that the
plaintiff had already received her share from the parental
properties and in her greed for more, she had used ... suspicious
circumstances.
11. That the plaintiff who had already received her
share from parental property in her greed has used
her force, undue influence
Lakhs from the deceased on account of his share in his
parents' property and he had acknowledged that he had
no further right ... from the deceased mother, the testatrix on account of his
share in his parents' property. It is clearly mentioned in the
document that after
parents and have no independent right in the
subject house.
E. In terms of Section 212 of the Indian
Succession Act, even the parents share ... share in the said property
and bequeathed her share in the suit house to her three sons
defendants no. 2 to 4 in equal shares

parents in order to avoid giving
sister Ms. Hitesh Kanti Arora/complainant no.1 bequeathed his
share in his parental property in favour of complainant no.1 vide a registered will ... husband Brij Bhushan Kathuria had decided to bequeath his share in his parental
property in favour of his elder unmarried sister and the accused
claimed that plaintiff, defendant number 4 and 5
were given shares by their parents at the time of marriage, but, not a single

parents had already given the shares to their daughters including the
plaintiff in support of which
four brothers, it was decided that plaintiff shall relinquish his
