follows;
"Liability of a partner for acts of the firm.
Every partner is liable jointly with all other
partners and also severally ... does not
distinguish between sleeping partners and managing
partners. Consequently, the contention that defendant No. 3
was a sleeping partner as stated in the retirement
business and also informed the revisionist that
she will become sleeping partner and need to invest money only
and respondents will be responsible and liable ... namely M/s P.D. Enterprises and made the
revisionist as sleeping partner and started "Triple 333 Lounge
Bar Restaurant" (a unit
sons of the petitioner, namely Sh. Pankaj
Gujral, who was a sleeping partner in the
said partnership business, has however
permanently shifted alongwith his family ... clear from the
partnership deed itself which mentions here as a Sleeping
Partner. Thus, it is clear that she has no requirement, much less
plaintiff namely Sh. Rajmal Sharma had all along been a sleeping partner. He
died on 31.12.2007 and thereafter another partnership deed was executed ... that is, 01.05.2009 to 30.04.2022
and the plaintiff was also a sleeping partner in that partnership.
(7) It is further the case of the defendant
issue during the Notice
framing stage that she is a sleeping partner in accused no.4 and thereby she has
no idea of the transaction ... onus of proving the fact that she is a sleeping partner and
unconnected with the affairs of the accused no.4 is upon accused
both Sh. Vinod Kumar Bansal and Sh.
Pradeep Gupta were the sleeping partners and shall be entitled to
receive ... said firm.
5. That the second party shall be sleeping partner, who shall be entitled to receive a sum
of Rs. 14,000/- (Rs. fourteen

dated 11.02.1988. Plaintiff no.2 was a sleeping partner and the
entire functioning of the partnership firm was managed ... dated 11.02.1988. Plaintiff no.2 Smt.
Shakuntala Rani Taneja was a sleeping partner and the entire
functioning of the partnership firm was managed
stated by the accused no.
04 that she is only a sleeping partner in the partnership firm and
she owes no liability towards the complainant ... aware whether the
accused no. 04 was a sleeping partner of the accused no. 01 or
not. Witness stated that cheques were issued
Lacs and further Rs. 1.30 crore
had been invested by other sleeping partners i.e., Rahat, Matloob,
Nursat and Waqar through cheques. The said amount ... partners, thereby the names of the aforementioned sleeping partners
were not mentioned in the sale agreement. The perusal of the bank
statements of the applicant
Notwithstanding the retirement of a partner from
a firm, he and the partners continue to be liable as
partners to third parties ... partner.
(4) Notices under sub-section (3) may be given by the
retired partner or by any partner of the reconstituted
firm." (emphasis supplied
