and disappearance of his sister-in-law Kausarbi ... alleged abduction and
fake encounter of the brother of the writ petitioner
Sohrabuddin by the Gujarat Police Authorities. The writ
petitioner also seeks the registration
death of Tulsiram Prajapati, a material witness to
the killings of Sohrabuddin and his wife Kausarbi to the CBI, in Narmada Bai

that as per CBI, the alleged criminal conspiracy commenced when
Sohrabuddin and Kausarbi (whose deaths were in question in the first
investigation
revealed that during the year 2004, the criminal gang of
Sohrabuddin had become very active in the area of
Rajsamand, Nathdwara, Sukher and Udaipur ... return they were obtaining protection money from them.
Gang of Sohrabuddin Shaikh wanted to take all the share of
protection money by getting
persons in brief. The prosecution case is to the following
effect :
(a) Sohrabuddin Shaikh (since deceased) was a dreaded
criminal, against whom offences of murder ... desperately searching for his
whereabouts. Kausarbi (since deceased) was wife of
deceased Sohrabuddin Shaikh. Tulsiram Prajapati (since
deceased) was an aide of deceased Sohrabuddin Shaikh
Police (Crimes and SIT), Hyderabad, Andhra Pradesh, with
regard to the Sohrabuddin encounter case was published by the appellants in
the respective publications ... telecast on CNN-IBN English
News channel under the caption “30 minutes- Sohrabuddin the Inside Story”
on 13.5.2007 at 1730 hours, which is subject matter
occurrences, inasmuch as one being the
conspiracy relating to the murder of Sohrabuddin with
the help of Tulsiram Prajapati and the other being the
conspiracy ... murder Tulsiram Prajapati - a potential
witness to the earlier conspiracy to murder Sohrabuddin.
We are unable to accept the claim of the learned
occurrences, inasmuch as one being the
conspiracy relating to the murder of Sohrabuddin
with the help of Tulsiram Prajapati and the other

to murder Sohrabuddin. We are unable to accept
the claim of the learned ASG. As a matter of
fact, the aforesaid
occurrences, inasmuch as one being the
conspiracy relating to the murder of Sohrabuddin
with the help of Tulsiram Prajapati and the other

to murder Sohrabuddin. We are unable to accept
the claim of the learned ASG. As a matter of
fact, the aforesaid

investigation of the case relating to the
killing of Sohrabuddin and Kausarbi to
CBI, this Court, by order dated ... have been killed because he
was an eyewitness to the killings of
Sohrabuddin and Kausarbi.
