ORDER
The petitioner calls in question the split charge sheet in
C.C.No.770/2022 registered for offences punishable under ... persons.
Since the petitioner and accused No.3 remained absent, a split
charge sheet was filed against accused No.2 in the year
sought to be tried in the subject
crime now on the split charge sheet in C.C.No.903/2018. It is
the continuance ... escaped trial and had to be tried now under the
split charge sheet, notwithstanding the facts, offences and the
evidence are similar to that
relevant point of time to
conclude the trial, a split charge sheet was laid against the
petitioner in C.C.No.859/2018 ... separate charge was framed against the
petitioner. The charge sheet filed were the same against both
the accused. The charge framed are also same against
were appeared before
the Court. Split up charge sheet has been filed
against petitioner-accused No.8 in CC
No.967/2016 ... petitioner was
arrested and proceedings were revived
against him in the split charge-sheet...... In
the instant case also the full-fledged trial
was held
absconding case was split up against them and
investigation officer thereafter laid the Split up charge
sheet in C.C.No.1790/2017 ... Split up C.C.No.1790/2017. In the said split-up
charge sheet, this petitioner is arraigned as accused

read with Section 34 of IPC. Thereafter,
it appears, a split-up charge sheet filed against this
petitioner in the above said Criminal Case ... accused persons. Merely because the accused were

against them, the accused persons cannot be tried
