respondent Bank could not have stopped the payment under the
Bank Drafts, leaves whereof had been stolen/robbed, he stated that it is not
possible ... subject Bank Draft that the Bank Draft
leaf of that number had been stolen/robbed from it. Nothing prevented it
from stopping payment under such
Mithan Lal Mangal Sain (plaintiff No. 3). The draft was a crossed one. The draft was sent by plaintiff No. 2 to plaintiff ... wrote to Bank of Baroda (defendant No. 2) about stopping payment of the said draft.
(5) Defendant No. 2, however, informed the plaintiff by their
PRESENT THE SAME FOR PAYMENT.

PAYMENT INSTRUCTION AGAINST THE MISSING
CHEQUE/DRAFT; AND
(C) THE CONCERNED BANKS
August, 2006 was also dishonoured on presentation
for the reason "payment stopped by drawer". Once again the
respondent company requested the petitioner ... demand draft made in
favour of the petitioner for a sum of ` 2 lacs and that the balance
payment would be made shortly. The respondent
Chitrakoot had only furnished
cheques and not demand drafts, which were dishonoured
/ payment stopped. The valid bids given were considered
and inter se bidding
sending bills for payment.
Q.29 When being Store Head Constable you come to know that
bills had been sent for payment action whereas ... work of these
vehicles had not been completed then draft will be stopped after
receiving payment.
Q.33 Do you work under
draft. On 15/2/85 the defendant Bank wrote a letter to the drawer bank requesting to issue a duplicate draft as the said draft ... letter dated 20/3/85 advised drawee bank to record stop payment. All this correspondence entered into by defendant No. 1 with its correspondent bank
that the language of the notice "kindly arrange to make the payment to avoid the unpleasant action of my client" was sufficient ... stop payments." The notice concludes by saying "please ensure to release payment, urgently to us by Demand Draft to avoid any further action
