was entitled to get the payment of drafts stopped as against strangers. He
could not, however ... State Bank of Indore
was, therefore, right in refusing to stop payment when the drafts were

its service branch in Delhi by fax as well ... draft was in total as Rs. 1,66,560/. The

However PW1 has denied knowledge of fact if any stop payment was recorded in respect of
the drafts in question ... time for the plaintiff bank to have received notification for stop payment
of said draft. There is no explanation given to justify why the information
sending bills for payment.
Q.29 When being Store Head Constable you come to know that
bills had been sent for payment action whereas ... work of these
vehicles had not been completed then draft will be stopped after
receiving payment.
Q.33 Do you work under
advertisement wherein it is mentioned that the applicant must
deposit a demand draft.
5. I have heard the learned counsel for the parties and
perused ... purchaser is not entitled to ask the
issuing bank to stop payment of the draft to the payee and it can
be done only with
inclusive of water charges.
Defendant further claimed to have regularly made the payments of rent till
October, 2012. It is further submitted that after October ... therefore, defendant made the payments
of rent through bank draft till 31.12.2012. Payments of rent was however
stopped from January, 2013 as plaintiff expired
