hereinabove. Therefore, the stray sentence of the
witnesses cannot be relied upon.

16. Furthermore, the evidence ... regard
to the same. Therefore, merely to hold on to a stray
sentence of both the witnesses, in our considered view
will
Prosecutor.
In the course of the cross-examination, there is a stray
sentence mentioned by her that, "It is true to suggest that
thereafter ... they all went in the said car."
Based on this stray sentence of the witness, the prosecution
contends that it has proved the last
appellant, the Court shall not place reliance on a stray sentence in
the cross-examination of the witness. I am fully agreeing with the
contention ... appellant. Appreciation
of evidence does not means placing reliance on a stray sentence in
the testimony of the witness. It is needless to say that
insured vehicle. The Tribunal has
erred in relying upon one stray sentence in the cross-examination of
appellant/Claimant-Devendra Kumar regarding his admission ... entry. In the considered opinion of this Court, one stray
sentence in the cross-examination of appellants/Claimants cannot be
made basis to hold that
injured/first informant in his evidence has stated a stray
sentence that the accused have prevented them from discharging
their duties. However, the evidence ... prevent
them from discharging their duties as public servants. Except a stray
sentence in the evidence of P.W.1 that the accused have prevented
could not remove the tap.
The mere fact that the aforesaid stray sentence has
been stated by PW2 Tilak Ram in his cross
examination ... witness.
Considering the fact that one stray sentence appearing
in the cross examination of the crucial witness does not
effect the credibility of the said
nervous or confused to speak and
her silence or a confused stray sentence may be

wrongly interpreted as “discrepancies and
contradictions” in her evidence
exaggerated version with
a view to get more compensation. One such stray sentence will not
tilt the balance against the appellants. The material needs
that the BOOK has to be read as a whole and stray sentences cannot
be picked out whilst determining whether a work such
logically
flowing from it. Judgments cannot be read as statutes.
A stray sentence picked out of context, cannot be used
to turn its ratio around
