short of a fertile womb being offered by a surrogate
mother for the growth of child of someone
else. The assessee supervises and oversees
counsel for the petitioners pointed out that rearing
child is as important as bearing the child and therefore, grant of maternity
leave is imperative even ... when the (mother) petitioner, being the
genetic mother, commissioning a surrogate, to bear her child, sought
maternity leave, as if she underwent the maternity, whether
issued a number of
guidelines as to how a child should be treated when the child is produced
along with his mother in the Court ... upon reaching the age of six years, the child
shall be handed over to a suitable surrogate as per the wishers of the female
prisoner
Rights of the Child in particular its Article
12 which reads as under:-
"1. States Parties shall assure to the child who is capable ... affecting the child, the views of the child
being given due weight in accordance with the age and maturity
of the child.
2. For this
