Abid Ahmed-PW-2, it was seized from
police station, Tumkur stating therein that
a Sony company Tape Recorder fitted to his Tata Sumo
bearing registration No.KA-06-M-8448 was stolen ... punishable under Section 379 of IPC. During the
course of investigation, tape recorder was recovered from
the possession of PW-2 Gangadhar, who inturn stated
Giri AIR 1971 SC 116, observed as
under :
"23. Tape recorded conversation is admissible
provided first the conversation is relevant to
the matters ... identification of the voice; and, thirdly, the
accuracy of the tape recorded conversation is
proved by eliminating the possibility of erasing
the tape-record
regard to the demand of
bribe and the said conversation was tape recorded. Thereafter,
the tape recorded conversation was heard and its transcript
was prepared ... state that the said
discussion with the accused was even tape recorded. He
categorically denied that the said conversation was not
recorded. Rather
they installed the cassette recorded and recorded the
conversation. Neither sample voices were taken nor asked that their
voices were recorded. Every time, they tried ... There are questions on the recording of ransom call. PW15 was
ignorant about the recording in the cassette recorder. There was no
departure or arrival

Recorder when she reiterated that in the Transcription
recorded on 23.05.2007 pertaining to telephonic ... recorded on the DVR which infact was handed over to her
subsequently. She could not say if the recording therein was
done on a tape

Metro Station, a Tape Recorder was affixed near Belt of his
