provided various customer
services and facilities such as cheque books, Temporary
Overdraft Facility (hereinafter as TOD) etc.; that in the month
of June 2008, defendant ... each in her
current account with the plaintiff bank for temporary overdraft
(TOD) against said cheques by allowing the cash withdrawal;
that the said
disputed. Defendant has also not denied the availing of temporary
overdraft facility by him. With respect to the plaintiff bank filling up the rate
plaintiff, it is observed that
plaintiff bank had sanctioned a TOD(Temporary Overdraft)
facility of Rs. 95,000/ to the defendant. The plaintiff bank

requested in month of February, 2010 for temporary overdraft
facility for Rs.25,000/-.
5. It is stated that plaintiff bank considered ... said current

defendants despite several reminders
stated that during course of banking business,
defendant requested for temporary overdraft facility for Rs.
1,25,000/- with the assurance that he will clear ... avail. It is stated that amount of said
temporary overdraft facility alongwith interest has not been paid
by defendant despite several reminders. It is stated
recovery of Rs.91,022.95 as outstanding dues of overdraft facility.
2 The plaintiff is a body corporate constituted under the
Banking Companies (Acquisition ... bank and having the temporary over draft facility. It
is averred that on 30.03.2009 the defendant took a temporary overdraft
facility
question of temporary mismatch. Own capital deployed in
income earning asset and on purely temporary basis. Assessee has
utilized facilities for giving temporary advances ... interest paid on
overdraft facility which is not utilized towards capital expenditure or
personal expenditure disallowance made that of overdraft interest

circumventing bank rules, regulations by corrupt or
