assessee in the said case was Rs.33.10 crores while the turnover of the assessee in

Having regard to all these facts, we are of the view
basis of turnover. Reliance
has been placed on some decisions of the Tribunal in support of the plea for
applying turnover filter for selection ... risk taking capabilities in cases of high
turnover companies, which increase the margins with rise in turnover.
However, in the Tribunal decisions cited, no detailed
constraint to provide for such substantial credits
especially considering that the total turnover was only Rs.1.76 crores, the
assessee was required to justify ... prevalent market rates. Further that the said company
had a total turnover of Rs.26.24 crores out of which there were debtors
outstanding
