17. The alleged Will dated
Shri Laxman Singh in favour
of the present Petitioner (which is unregistered), an affidavit receipt of
possession letter „Deed of Will‟, and an irrevocable General
steps towards partition at some time in the future. The MoU is
unregistered. It is settled law that a Partition Deed must ... between the parties, will be admitted in evidence even though
they are unregistered, to prove the fact of partition."

Petitioner has relied on the "khatauni"
records and an unregistered sale deed dated 28th August 1991, to justify its
title/ownership over
Petitioners in para 3(iii) of the petition claim ownership through
unregistered power of attorney, Agreement to sell, purchase receipts, Will
etc. It is also
tenant in
property No. D-45/46, Sector 63, Noida in an unregistered lease
arrangement and the said entity has now been permitted to move
crystallized the law relating to passing off on
the basis of unregistered trademark. It was held that in the case of un-
registered trademarks
biswa in the revenue estate of village Mohammadpur
Majri, Delhi vide registered/unregistered General Power of
Attorneys/Agreement to Sale etc.
