subjects, the same was taken as unsatisfactory performance of the
appellant, which was not permissible. Mr. Oza submitted that ... explanation of
the appellant was called for as regards his unsatisfactory
performance during his probation period, it is no ground to suggest

undertaken, his performance was assessed and the competent authority
found his performance unsatisfactory.
