despite the service of the said letter the respondent management
refused to reinstate ... alleged to have been sent by the respondent to the petitioner
through UPC. Counsel also submitted that the service by way of
UPC
sending notice by registered AD has not been filed
and only UPC receipt is filed. The UPC was never served personally and
the landlady ... herself residing in the same premises. Moreover, sending
of notice by UPC is not valid notice. For raising this submission, reliance
was placed on DCLR
that he had already sent the
valuation report on 21.2.04 through UPC before noon so there was no
occasion for him to accept the bribe ... Officer at that time that he had already sent the report through UPC.
Conduct of the accused is very relevant. Here it is useful

defendant. As the UPC has not been received back and has been
addressed to the correct
letter written by him to the petitioner and
dispatched under UPC. The said letter was dispatched to the petitioner on
11.01.2010. On 04.03.2010 matter ... letter dispatched by the counsel for
the petitioner on 11.01.2010 through UPC in the normal course of postal
business. But still petitioner has not been
issued a
Legal Notice through his Counsel by Regd.AD and UPC to the
defendant thereby calling upon him that he has arranged the balance ... said Legal Notice dated 13.10.2005 vide reply
dated 17.10.2005 by UPC and the defendant has stated therein that he
would be available at the office

UPC. It is mentioned that the notice dated ... respectively. The original UPC receipt
is Ex. PW1/7 in which also both the addresses of the
respondent are mentioned. One AD card
served on the respondent through
regd. AD as well as UPC. The registered envelope was returned as
`unclaimed' and the UPC was duly served ... alleged, was served upon the respondent either by regd. AD or by
UPC.
5. In the replication to the written statement the contents
receipts (Exs.PW2/2, PW2/3 and PW2/4), UPC
(Ex.PW2/5), three receipts of speed post ... defendant.
In this connection, the witness relied upon the postal receipts, UPC, two
Acknowledgment Due cards and one return envelop which were marked
notice of demand dated 12/12/2005 through registered AD and UPC.
