chief examination complainant identified the
accused, however, in cross examination complainant changed his
version and did not support the prosecution case and when
complainant ... Addl. P.P. also sought
explanation from the complainant for changing his version during
cross examination to which the complainant answered as under
spot
was used in this case.
Although the version has been changed by the panch
witnesses that when it was played at the showroom there
whereas
in his statement dated 2/4/2009 now he has
changed his version by stating that person he saw

by stating that the person was having black hair
and his hair style
statement in material particulars by stating
inconsistent facts or had changed his version by narrating
new facts which were destructive of the prosecution case ... Magistrate of first class is

version is of such a nature that the witness is guilty
stands deleted."
