that basically three
issues are involved in this case.
A. Whether vocational instructors can be treated at par with teachers in

+2 schools ... Instructors were fixed. In W.P. (S) No. 2696/2009 and other analogous
cases, the petitioners were the Instructors in vocations course in +2 School
laid to the decision dated
20th June 2008 by which the Vocational Instructors are debarred from consideration
for appointment on the post of Headmaster ... From the materials on record, it is apparent that the Vocational
Instructors were appointed under a scheme and while so their term of appointment
would
other teachers?
(ii) When vocational students are treated as regular
students by the Jharkhand Academic Council then, why not vocational
instructor ?
(iii) How Service Rule ... about

Teachers but nowhere the Vocational Teachers posts have been
mentioned, therefore, the petitioners being vocational instructors are not
eligible to be considered
serial no. 298, scale of Instructors has been indicated,
the same is quoted hereinbelow :-
"Note:- Regarding all Instructors/Vocational teachers
in the different training ... said note
indicated in the Gazette Notification(supra), for all
Instructors/vocational teachers in different training
colleges/10+2 schools at present drawing pay scale
Instructors/ Vocational Teachers. As the petitioners were fulfilling the
requisite qualification as mentioned in the Central Govt. guidelines of
Vocational Teachers/ Instructors, their pay-fixation ... Secondary Education, Bihar, Patna, by which it has
shown that the Vocational Instructors are getting G.P. of Rs.4200/-.
Hence, the petitioners have approached

faculty staff, LDC etc. were prescribed by the Directorate of Education,
NCERT. The qualification of the Vocational Teachers/Instructors was
