Indian Contract Act, 1872
(hereinafter referred to as the Contract Act ), deals with
voidable contracts and void agreements. Section 10 of the
Contract Act provides

It follows that in every case where ... compromise
and the decree that would make the same void or voidable
under the Contract Act . More importantly, Order XXIII Rule 3A
clearly bars
says that an agreement or

Contract Act ..." shall not be deemed to be lawful ... compromise has to examine whether the compromise was void
or voidable under the Indian Contract Act . Even Rule 1(m) of
Order 43 has been

voidable.

Chapter-II of Indian Contract Act, 1872 , deals with
contracts which are voidable contracts and void agreements
and all such agreements and contracts that fulfill
that under Section 21 of the Indian Contract Act, 1872, a contract is not
