2. Pursuant to purchase
observed
that in case of wrong shipments where no mala fide is suspected re-
export may be allowed on payment of a nominal penalty
certification. On misdeclaration of
goods, Shri Mahesh Bhanushali had submitted that wrong shipments have
been sent by their overseas suppliers, which was found ... impractical that all the
five overseas suppliers would supply wrong goods. The Adjudicating
Authority had also taken note of the fact that Shri Mahesh Bhanushali
either by the importers or appellant CB, for their claim regarding
wrong shipment prior to interception of the aforesaid consignments by the
CIU of JNCH ... respect of Specified Goods:

In the event of any non-declaration or wrong or improper or incorrect or
insufficient or mis-declaration of documents
wherein the re-export of the wrongly shipped
goods by the foreign supplier was allowed, by taking into account ... bonafide of the appellants, by taking immediate steps, on detection of
wrong shipment and by holding that there cannot be any mala fide
payment to the supplier as the supplier has sent a wrong
shipment to the appellant. The appellant requested the Department to
permit them to abandon
