part of the deceased, the deceased
was crossing the road where there was no pedestrian
crossing or zebra crossing. Thus, he too has
contributed ... insurance company
contended that the deceased was crossing a road
where there was no pedestrian crossing or Zebra
crossing, thus he too has contributed
without observing the flow of
traffic and where there was no zebra crossing.
Hence, he sought for dismissal of the petition. The
respondent
crossing the road at a spot where there was
admittedly no zebra crossing. It is also submitted that the
Tribunal erred in deducting
without observing the
vehicles on the road and there is no zebra crossing for
pedestrians to cross the road. While so crossing
deceased himself slipped ... road without
following the traffic rules and there was no Zebra
crossing for the pedestrians to cross the road. While
crossing the road, the deceased
going vehicular
movements and was negligently crossing the road
without choosing Zebra crossing meant for pedestrians
to cross the road. The age, avocation and income
road without observing the ongoing vehicles
and where there was no zebra crossing and that the Tribunal
has after meticulous appreciation of all the evidence ... crossing the road at a place where there was no zebra
crossing may at the most constitute an offence under the
Act. However, to prove
that on 02.12.2015 at about 9.15
p.m., when deceased was crossing Old Madras road and
when he came in front of Vijaya Bank, at that ... negligence on the part of the deceased as there was no
zebra crossing. It was further pleaded that the driver of
the offending vehicle
where there was very dense
traffic movement and there was no zebra crossing. The
Claims Tribunal, however, held that the claimants are
entitled ... cross the road from the
place where there was no zebra crossing, is based on the
Surmises and Conjectures and cannot be accepted.
Therefore
accident by the Insurance Company, the following
suggestions made during the cross-examination of P.W.1
are material. The respondent No.2-Insurance Company ... road. There is also a suggestion that there was no
zebra crossing at the accident spot. There is a further
suggestion that amputation
