The following were present:

Sr. Supdt of Post Offices, South Hooghly Division, Serampore, heard through
video conferencing.
ORDER
Information Sought:
The appellant filed an RTI application on 05.08.2018, seeking information on seventeen points as follows:
1) "Kindly confirm that the Deptt. of Posts under Govt. of India is running loss for the year of 2015-16, 2016-17 & 2017-18, if so, the amount may be informed.
2) Copy of the RTI application dated 17-06-2013 of Ratan Chandra Bag, PA, Serampore HO registered at South-Hooghly Postal Dn. under No. SH/RTI/283/06/2013 with reply communicated to him may kindly be supplied.
3) Copy of the Postmaster General, SB Region letter no. PMG (SB)/EST/A/( CASUAL LABOURES dt. 10-1-2013 requested for supply).
4) Information about number of outsiders engaged as DRM at Serampore H.P.O. for the period of 1-1-2016 to 31-12-2016, 1-1-2017 to 31-12-2017 & 1-1-2018 to 31-7-2018 against category of Postal Asstt./POSTMAN/Group-
d intimated.

5) Name of the outsiders engaged as DRM for the period of 1-1-2016 to 31-12- 2016, 1-1-2017 to 31-12-2017 & 1-1-2018 to 31-7-2018 datewise may kindly be intimated.
6) Whether outsiders engaged as DRM at Small Saving Bank Points/Speed-Net I R-Net / Cash counting points are as per order of the Govt. of India, please confirm with the supply of specific order of the Govt. of India.
7) Kindly confirm that the job/work of CASH HANDLING, SB POINT/SPEED-NET, R-NET have been entrusted to clerical staff (PA) & Delivery-Staff' (POSTMAN) with rating of the Department.
8) Supply ruling of the Govt. of India that the DRM have to be engaged against the points of SB/CASH/SPEED-NET, R-NET in place of regular staff of clerical/delivery staff.
9) Kindly confirmed that the require PASSWORD allotted to the DRM for working.
10) Total expenditure incurred for engagement of DRM for work of SB/ SPEED-NET/R-NET/Cash-handling datewise from 1-1-2017 to 31-7-2018.
11) Copies of the administrative orders on the strength of which those are engaged & paid salary/wages are also requested to supply for the period of 1-1-2017 to 31-7-2018.
12) Rates at which each of the said outsiders (DRM) paid may please be informed datewise from 1-1-2017 to 31-7-2018.
13) Engagement for work as an outsider on Daily-wage basis of Delivery work against short term vacancies at Serampore H.P 0. & various offices is Page 3 of 7 CIC/POSTS/A/2018/168999 violation of Deptt. ruling. Please confirm with supply of relevant sections of ruling.
14) Copies of the Paid-Vouchers for the month of Januaty '18 to July '18 through which the outsiders (DRM) paid are requested to supply.
15) Please intimate the name of the Sr. Superintendent/Sr. Postmaster/ Supervisors of Serampore H.P.O. who engaged & allowed to engage outsider as DRM fir the period of 1-1-2016 to 31-7-2018.
16) Please intimate the name of Union/Association leaders lead by Leftist / Congress / TMC/ RIP who are insisting with Sr. Superintendent / Sr. Postmaster Serampore HPO. for engagement of DRM.
17) Please supply the CCTV footage for the period of May 2018 to July 2018 for the section of SB/Cash /Delivery of Serampore H.P.O."
The CPIO, South Hooghly Division, Serampore, vide letter dated 17.09.2018, provided information on point nos. 4, 13, 15, 16 & 17 to the appellant. Being dissatisfied, the appellant filed first appeal dated 24.09.2018. FAA's order, if any, is not available on record.
Grounds for Second Appeal:
The appellant filed second appeal u/s 19 of the Act on the ground of unsatisfactory reply furnished by the respondent. He requested the Commission to direct the CPIO to provide the information sought for.
Submissions made by Appellant and Respondent during Hearing:
The appellant reiterated the contents of his written submissions and submitted that partial information has been furnished to him on point nos. 4, 13, 15, 16 and 17 Page 4 of 7 CIC/POSTS/A/2018/168999 only. Further, no information has been furnished to him on the remaining points till date. He requested the Commission to direct the CPIO to provide complete information sought for.
The written submissions dated 05.08.2020, filed by the appellant, were taken on record.
The respondent relied on his written submissions and submitted that the ADPS-III & CPIO, O/o Postmaster General, South Bengal Region, vide letter dated 30.08.2018, supplied information on all points except point nos. 4, 13, 15, 16 and
17. Further, information on point nos. 4, 13, 15, 16 and 17 was supplied by the CPIO, South Hooghly Division vide letter dated 17.09.2018. Hence, no further information remains to be provided by the respondent.
The appellant contested that the letter dated 30.08.2018 was not received by him.
The written submissions dated 25.09.2020, filed by SSPO, South Hooghly Division, Serampore, were taken on record.
Decision:
The Commission, after hearing the submissions of both the parties and perusing the records, observes that as per the respondent, information on all points except point nos. 4, 13, 15, 16 and 17, was provided to the appellant by the ADPS-III & CPIO, O/o Postmaster General, South Bengal Region vide letter dated 30.08.2018. However, the appellant claims to have not received the said letter. In view of this discrepancy, the Commission directs the CPIO, O/o Postmaster General, South Bengal Region, Kolkata to resend the letter dated 30.08.2018, along with all necessary documents and proof of dispatch with respect to the dispatch made earlier to the appellant.Page 5 of 7
CIC/POSTS/A/2018/168999 The Commission, further, directs the CPIO, South Hooghly Division, Serampore to send a copy of their written submissions dated 25.09.2020, to the appellant. The above directions of the Commission shall be complied with within a period of 15 days from the date of receipt of a copy of this order, under intimation to the Commission With the above observations, the appeal is disposed of.
Copy of the decision be provided free of cost to the parties.
The appeal, hereby, stands disposed of.
