ORAL ORDER
2 25-03-2019The learned counsel for the petitioners submits that the present case is squarely covered by a judgment dated 27.09.2016 rendered by the learned Division Bench of this Court in L.P.A. No. 1699 of 2013 (Kranti Kanak & Ors. vs. The State of Bihar & ors.).
Per contra, the learned counsel for the respondents submits that the respondent no. 6 shall examine the case of the petitioners and take a final decision and in case their cases are found to be similar, then similar benefits would be given to them.
Having regard to the facts and circumstances of the case, the present writ petition is disposed off in terms of the Patna High Court CWJC No.5162 of 2019(2) dt.25-03-2019 4/4 aforesaid judgment with a direction to the respondent no. 6 to consider the case of the petitioners and in case it is found that the petitioners are similarly situated, the similar benefits as has been granted to the appellants of the aforesaid judgment, shall also be granted to the petitioners herein.
The entire exercise regarding examination of the case of the petitioners and grant of similar relief as granted to the appellants of the aforesaid judgment, should be completed within a period of twelve weeks from today.
The present writ petition stands disposed off on the aforesaid terms.
