JUSTICE PUSHPENDRA SINGH BHATI (Downloaded on 29/08/2019 at 10:48:32 PM) (36 of 40) [CW-10843/2019] Judgment 06/08/2019 The petitioners have preferred this writ petition under Article 226 of the Constitution of India claiming in sum and substance the following reliefs:
"It is, therefore humbly prayed that Your Lordship may graciously be pleased to accept and allow this writ petition and by an appropriate writ, order or direction:-
1. The respondents may be directed not to replace the petitioners (contractual employees) by another set of contractual employees for the reasons of change of placement agencies or otherwise in pursuance of the invitation of the online competitive bid for vocationalisation of secondary and higher education by the respondents, in the interest of Justice.
2. The action-omission on the part of respondents in engaging the petitioners and taking the work through placement agency/service providers may be declared arbitrary and accordingly the respondents may be directed to directly engage the petitioners on contractual basis, without any involvement of any placement agency/contractor, and they may be allowed to continue till the regular selections are being made by the respondents, in the interest of justice.
3. The respondents may kindly be directed to allow the petitioners to continue to work as Vocational Teachers/Trainers at their respective posting palaces, where they are working presently, in the interest of Justice.
4. The respondents may kindly be directed not to replace the petitioners by another set of contractual employees.
5. The respondent be directed to pay due salary of the petitioners along with interest.

The petitioners have submitted these writ petitions where a clear stand is that they possess requisite qualification for being appointed as Vocational Trainers as required by the respondents and thus the State Government had accordingly decided to appoint them as Vocational Trainers in different sectors. The Government of India brought a Centrally Sponsored Scheme of Vocationalisation of Secondary and Higher Secondary Education by integrating employability education into School Education in September, 2011. The scheme is operated within the National Skills Qualifications Framework. This establishes a system of clear educational pathways from school to higher education while providing certification of vocational skills. The Government of India has sanctioned 220 schools for the academic year 2015-16 for the implementation of the Vocationalisation of Secondary and Higher Secondary Education Scheme. The project was to be implemented in 220 Government schools and the goal is to empower employability amongst the students. The project in question was to be done with curriculum, trainer and handbook for the same was also developed. The scheme/project was sought to be implemented and in this regard, the petitioners who are having requisite qualifications and were eligible to be appointed by the respondents were appointed and ordered to be posted at different schools as Vocational Trainers.
Learned counsel for petitioners submits that petitioners are discharging their duties as Vocational Trainers with utmost satisfaction and in accordance with the scheme of the project.
(Downloaded on 29/08/2019 at 10:48:32 PM)(38 of 40) [CW-10843/2019] Learned counsel for petitioners further informs the court that the Rajasthan Madhyamik Shiksha Abhiyan is being given a new nomenclature as Samagra Shiksha Abhiyan.
Learned counsel for petitioners submits that grievance of the petitioners is that as per the Policy, the implementing agency has issued an order on 11th February, 2019, whereby the instrumentalities of Samagra Shiksha Abhiyan have been directed that services of the District Project Coordinators and the Vocational Trainer Providers may not be continued. Such order was subsequently withdrawn by the respondents themselves and the terms & conditions of the contracts on which the petitioners were given appointment were decided to be followed. The respondents, however, passed another order on 20 th May, 2019, whereby the respondents are inviting fresh competitive bid of the service providers to provide Vocational Trainers in addition 905 schools. Learned counsel for petitioners submits that petitioners have an apprehension that they shall be substituted by another set of contractual employees.
Learned counsel for respondents however categorically submits before this court that any new process being initiated vide order dated 20th May, 2019 shall not be detrimental to the interest of the petitioners. Learned counsel submits that 20 th May, 2019 is an independent exercise and it shall not prejudice the petitioners.
The stand of the respondent counsel is that the petitioners shall not be substituted by another set of contractual employees, who shall enter during the exercise arising out of the order dated 20 th May, 2019 and therefore, there is no requirement of granting any indulgence to the present petitioners against the exercise of 20 th May, 2019.
(Downloaded on 29/08/2019 at 10:48:32 PM)(39 of 40) [CW-10843/2019] Learned counsel for respondents however opposes the prayer that any kind of indulgence regarding order dated 20 th May, 2019 ought not to be granted by this court as it will be against the spirit of Samagra Shiksha Abhiyan which is necessary for strengthening subject of Vocational Training which is increasing the employ-
ability amongst the larger spectrum of the students. Learned counsel for respondents also submits that the petitioners have prematurely approached this court as no decision prejudicial to them has been taken by the respondents.
After hearing the learned counsel for the parties and looking to the factual matrix of the case, this Court deems it appropriate to dispose of these writ petitions while intervening on a limited count, which is that if the petitioners are having proper qualification and are eligible to be appointed as Vocational Trainers and were duly selected by the respondents strictly in accordance with law on contractual basis, then their services shall not be replaced by another set of contractual Vocational Trainers to be appointed in pursuance of the order dated 20 th May, 2019. While observing as above, this Court makes it clear that this Court is not inclined to go into the legality of the order dated 20 th May, 2019 at this stage as the same is not prejudicial to the interest of the present petitioners. The protection to the petitioners shall be strictly as per their qualification and eligibility and appointment based on legal selection process for the contractual post of Vocational Trainers. The substitution shall not be made by another set of Vocational Trainers being appointed in pursuance of the order dated 20th May, 2019. The respondents shall, however, be free to conduct the services of the petitioners as per the existing project and scheme.
