JUSTICE ASHOK KUMAR GAUR Order 16/04/2019 The present batch of writ petitions is filed for claiming benefit of selection grade and fixation in the pay scale of Rs. 975-1720, 1200-2050 & 1640-2900 (Rs. 5500-9000) on completion of 9, 18 & 27 years of service on the post of Multipurpose Health Worker (MPHW).
Learned counsel submitted that issue of grant of such benefit is no more res-integra.
Counsel for the petitioners submitted that this Court has consistently followed the judgment passed in D.B. Special Appeal (Writ) No. 1068/2014 (Govind Dan Charan Vs. State of Rajasthan) and six other connected appeals decided on 17 th December, 2015 as the appeal of the State, was also dismissed by the Supreme Court.
This Court has also taken a view in catena of cases and as such reference is made of S.B. Civil Writ Petition No. (Downloaded on 28/06/2019 at 01:07:39 AM) (14 of 15) [CW-7025/2019] 3716/2018 (Shyam Singh Vs. State of Rajasthan & Ors.) dt.

Mr. Hemant Mathur Addl. Govt. Counsel appearing on behalf of the respondents does not dispute the legal position. The operative portion of the order passed by this Court in the case of Shyam Singh Vs. State of Rajasthan & Ors. (supra) is reproduced hereunder:-
"This Court in D.B. Civil Special Appeal (Writ) No. 1068/2014 (Govind Dan Charan Vs. State of Rajasthan & Ors.) and six other connected appeals had taken a view that the candidate should be entitled to selection grade and get fixation in the pay-scale of Rs.975-1720, 1200-2050 and 1640-2900 (5500- 9000) on completion of 9, 18 & 27 years of service respectively.
Mr. Sanjay Kumar Sharma, Govt. counsel for the State submits that the respondents are giving benefit to such employees, who had approached the Court earlier in terms of the judgment of Division Bench (supra). The present writ petition is allowed in the same terms as the order passed in D.B. Civil Special Appeal (Writ) No. 1068/2014 (Govind Dan Charan Vs. The present batch of writ petitions is also disposed of with a direction to the respondents to confer the benefits in favour of the petitioners in the same terms as the judgment passed in D.B. Special Appeal (Writ) No. 1068/2014 (Govind Dan Charan Vs. State of Rajasthan) and 6 other connected appeals decided on 17th December, 2015.
This Court after considering the legal position settled up to Supreme Court deems it proper to allow the present writ petitions and the entitlement of the petitioners in the pay scale of Rs. 975- 1720, 1200-2050 & 1640-2900 (Rs. 5500-9000) is maintained.
